2792.15. Reasonable Arrangements – Transfer of Common Areas and Facilities to Association.
(a) In subdivisions in which all or a portion of the common areas and facilities are to be transferred to the Association,
those areas and facilities shall be transferred to the Association or to a corporate trustee under a trust agreement
acceptable to the Commissioner prior to or coincident with the first transfer or conveyance of a subdivision interest by
the subdivider.
(b) The subdivider may create a contractual right in himself or may reserve easements of limited duration, for common
driveway purposes, for drainage and encroachment purposes and for ingress to and egress from the common areas for
the purpose of completing improvements thereon or for the performance of necessary repair work and, in the case of
phased subdivision projects, for entry onto adjacent property in connection with the development of additional phases
of the overall project.
