Illegal Practice of Law Punishable
6125. No person shall practice law in California unless the person is an active licensee of the State Bar.
[Note: The term “to practice law” and equivalent expressions are not confined to appearances in court. They include “legal advice and counsel and the preparation of legal instruments by which such legal rights are secured.” It has been held that the selection and preparation of a note, mortgage and deed of trust by a broker in an independent loan transaction, in which a fee was charged, was the unlawful practice of law, even though only one transaction was involved.
